SAFETY Act

The provision of quality security services is not the only way that Wackenhut assists its customers in mitigating their risk and minimizing their liability. As the first contract security company to receive designation and certification by the U.S. Department of Homeland Security under the SAFETY Act Wackenhut has taken a pro-active step to help protect customers in the face of an increasingly dangerous world. As part of the Homeland Security Act of 2002, Public Law 107-296, Congress enacted the Support Anti-terrorism by Fostering Effective Technologies Act (SAFETY Act) to provide “risk management” and “litigation management” protections for Sellers of qualified anti-terrorism technologies and others in the supply and distribution chain.

The SAFETY Act creates certain liability limitations for third-party claims arising out of a terrorist attack for sellers whose anti-terror products or services have been certified by the DHS in America’s fight against terrorism. These liability protections extending to Wackenhut’s customers if a future act of terrorism occurs. Should this happen, Wackenhut customers will benefit from affirmative defenses against liability for third-party claims because they purchased Wackenhut’s SAFETY Act approved services. Companies that purchase services from other contract security providers that have not been SAFETY Act approved would not enjoy such protections. As the leader in the security industry, Wackenhut continues to seek out new ways to provide value that extends beyond the primary service offerings.  SAFETY Act certification is noted by DHS as having the potential to have a positive impact on the cost and availability of terrorism risk insurance due to the reduction in liability exposure for both the providers and their customers.
